This dispute references a running case (a20120506.1)(“the running case”) and the claimant is not a party to that case. This contradicts Dispute Resolution Policy (DRP) in a number of areas with regard to the running case – in particular the authority of the Arbitrator to handle the case in any manner s/he sees fit subject to compliance with DRP. DRP 2.1 vests “full authority in Arbitrators to hear disputes and deliver rulings which are binding on CAcert and the Users” DRP 3.2 allows the Arbitrator to place the rulings from a case “under seal” DRP 3.2 also states “Proceedings are ordinarily private. The Ruling is ordinarily published, within the bounds of the Privacy Policy.” The processes during the handling of a case are normally private to the parties involved and thus any internal processing of this case is not required and should not to be made public. Before the running case is finally closed, under the terms of DRP 3.2, the Arbitrator must refer the decision to seal any or all of the case rulings to the Board of CAcert Inc. who will confirm or deny that the decision to seal stands. If the Board rule that the seal stands, the existence of such rulings must be made public, even if the content is not. After the running case has been finally closed, an appeal dispute may be filed if the current claimant (Benedikt) or any other party disagrees with the decision. I therefore dismiss this case.
